What Is FR-44 Insurance?
Despite its name, FR-44 insurance is not a separate insurance policy. Instead, an FR-44 is a certificate of financial responsibility filed by your insurance company with the Florida Department of Highway Safety and Motor Vehicles (FLHSMV).
Unlike an SR-22, an FR-44 requires drivers to carry significantly higher liability coverage limits. Florida typically requires an FR-44 after a conviction involving driving under the influence (DUI) or certain alcohol-related driving offenses.
Maintaining continuous coverage is critical. If your policy is canceled or lapses before your FR-44 requirement is complete, your insurance company must notify the state, which may result in another driver's license suspension.
The Limits Florida Requires on an FR-44
An FR-44 is not just “higher coverage” in the abstract. Florida sets the exact amounts in statute, and the bodily injury requirement is ten times an SR-22's.
- This applies to an owner or operator who — regardless of adjudication of guilt — was found guilty of, or entered a plea of guilty or nolo contendere to, driving under the influence under Fla. Stat. 316.193 after October 1, 2007.
- An FR-44 is not a policy. It is proof you can respond in damages at these higher limits, established by one of the methods in Fla. Stat. 324.031(1) or (2) and filed on your behalf.
- The bodily injury requirement is ten times an SR-22's. SR-22 financial responsibility under Fla. Stat. 324.021(7) is $10,000 per person, $20,000 per crash and $10,000 property damage — the two filings are not interchangeable.
- The statute provides an exemption: an owner or operator not convicted of driving under the influence or a felony traffic offense for 3 years from the date driving privileges were reinstated is exempt from this section.
